A woman suffered a severe head injury in a snow tubing accident caused by a negligently maintained run-out area.

Our client suffered a serious head injury requiring brain surgery when her snow tube flipped over at the bottom of the run. Our investigation revealed that the “run out” area was unduly treacherous from ice. Even worse, a rubber mat negligently placed by staff caused the snow tube to be catapulted into the air seriously injuring our client.
The challenge was to overcome New Jersey’s Special Benefits statute which was intended to protect ski and snow tubing facilities against injury claims, such as our client’s.
Our legal argument to overcome the protective statute was accepted by the presiding judge and provided the opportunity to resolve the case.
