We had to look for a “deep pocket” and brought a lawsuit against the restaurant under New York’s “Dram Shop Law”. The defense argued that the driver became intoxicated at two other locations and there was no way of knowing that the customer was drunk before leaving its restaurant. We prevailed on a unique theory of responsibility.
